Engraving Urns In the state of Ohio, who has legal rights to the possession of cremated remains?
My mother passed away and my crazy, estranged aunt showed up for the funeral- then took off with the urn containing my mothers remains. The funeral home handling the cremation said that she had legal right to the ashes (?!?) and released them to her without ever contacting me about the exchange- even though I am a legal adult, was the one handling the arrangements, took care of her throughout her illness, had power of attorney and was the sole beneficiary of her will. I absolutely did not want my aunt to have possession of the remains, as I expect to never see her again. Furthermore, the urn is a custom-made, double urn, already engraved for both my mother and my step dads remains ( for when my step dad ultimately passes). Can anyone help with info/advice specific to Ohio?
If everything you have described is coorect and true, then you absolutely have an issue. If you made the funeral arrangements and signed the funeral contract, then under NO circumstances should the funeral home have given them to ANYONE but you without your permission. Now, if she sined the contract, it would be another story. I would contact the state board that licenses funeral directors in that state and file a complaint. If you did as you said, the funeral home is in big trouble. Good luck.
